CarrumConnect Terms of Use

1. Acceptance of These Terms

These Terms of Use ("Terms") govern your access to and use of the CarrumConnect mobile application (the "App"), operated by Carrum Mobility Solutions Private Limited ("Carrum", "we", "us"). By installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not install or use the App.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under Indian law to use the App. The App is intended only for individuals who are authorised drivers, fleet operators, support staff, or other personnel onboarded by Carrum. Access requires credentials provisioned by Carrum.

3. Account and Authentication

  • The App uses your registered mobile phone number and a One-Time Password (OTP) for authentication. You must keep your SIM and device secure.
  • You are responsible for all activity that occurs through your account.
  • You agree to notify Carrum immediately at support@carrum.co.in if you suspect unauthorised access to your account or loss of your device.
  • Carrum may suspend or terminate your account if you no longer have an active relationship with Carrum, if you breach these Terms, or if required by law.

4. Licence to Use the App

Carrum grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, solely for the purposes intended by Carrum. This licence ends automatically when your association with Carrum ends, when you uninstall the App, or when Carrum terminates your account.

You agree that you will not:

  • Reverse-engineer, decompile, or disassemble the App except to the extent permitted by law.
  • Copy, modify, distribute, sell, or lease any part of the App.
  • Use the App to send unlawful, harassing, defamatory, obscene, or infringing content.
  • Use the App to transmit malware, spam, or any code that interferes with the App or its servers.
  • Attempt to gain unauthorised access to the App, other accounts, or Carrum's infrastructure.
  • Use the App in any way that violates applicable law, the Google Play Developer Programme Policies, or the Apple App Store Guidelines.
  • Use automated systems (bots, scrapers) to access the App or its data.

5. User Content

You retain ownership of the content you send through the App (messages, photos, audio, video, files). By sending content through the App, you grant Carrum a worldwide, royalty-free licence to host, store, transmit, display, and process that content solely as needed to operate and improve the App and to comply with legal obligations.

You are solely responsible for the content you send. You represent that you have all rights necessary to send it and that the content does not infringe any third-party rights or violate any law. Carrum may review, retain, or remove content that violates these Terms, but is under no obligation to monitor user content.

6. Services from Third Parties

The App relies on third-party services including Google Firebase, Sentry, and your device's operating system services. Carrum is not responsible for the availability or behaviour of these third-party services. Your use of them is also subject to their respective terms and privacy policies. The App may include links to websites or services not operated by Carrum; we are not responsible for the content, accuracy, or practices of those external sites.

7. Caller ID Feature

Important Disclaimer

The Caller ID feature is provided to help identify work-related incoming calls. Carrum does not guarantee that every call will be correctly identified, that the Caller ID overlay will appear in every circumstance, or that the feature will function on every device or Android version. You should not rely on the Caller ID feature for safety-critical or legally significant decisions.

8. Service Availability and Updates

Carrum may modify, suspend, or discontinue the App or any feature at any time, with or without notice. We may issue updates that you must install to continue using the App. Carrum is not liable for any loss caused by downtime, scheduled maintenance, or discontinuation of features.

9. Intellectual Property

The App, including its software, design, logos, trademarks, and content provided by Carrum, is owned by Carrum or its licensors and is protected by Indian and international intellectual property laws. Nothing in these Terms transfers any intellectual property right to you except for the limited licence in Section 4.

10. Disclaimers

To the maximum extent permitted by law:

  • The App is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation.
  • Carrum does not warrant that the App will be error-free, secure, or available at any specific time.
  • You use the App at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, in no event shall Carrum, its directors, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the App, even if Carrum has been advised of the possibility of such damages.

Carrum's aggregate liability arising from or related to the App shall not exceed ₹1,000 (one thousand Indian Rupees) or the amount you paid Carrum for use of the App in the twelve months preceding the claim, whichever is greater. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Carrum and its directors, officers, employees, and affiliates from any claim, demand, loss, or expense (including reasonable legal fees) arising out of: (a) your use of the App in violation of these Terms; (b) content you send through the App; or (c) your violation of any law or third-party right.

13. Termination

These Terms remain in effect until terminated. Carrum may terminate or suspend your access at any time, with or without cause, with or without notice. You may stop using the App at any time by uninstalling it and requesting account deletion as described in our Data Deletion Policy. Sections 5, 9, 10, 11, 12, 14, and 15 survive termination.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any dispute arising out of or in connection with these Terms or the App shall first be attempted to be resolved amicably through good-faith discussion within thirty (30) days of written notice. Failing amicable resolution, the dispute shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Gurugram, Haryana, and the language shall be English. Subject to the foregoing, the courts at Gurugram, Haryana shall have exclusive jurisdiction.

15. Changes to These Terms

Carrum may modify these Terms at any time. Material changes will be notified inside the App or by email at least seven (7) days before they take effect. Continued use of the App after the effective date constitutes acceptance of the revised Terms.

16. Miscellaneous

  • Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and Carrum regarding the App and supersede any prior agreement on the same subject.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
  • No waiver. Carrum's failure to enforce a provision is not a waiver of its right to do so later.
  • Assignment. You may not assign these Terms without Carrum's prior written consent. Carrum may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • Notices. Notices to you may be sent in-App or to the email associated with your account. Notices to Carrum should be sent to support@carrum.co.in.
